Acceptable Use Policy

What you can and cannot do with the GoDesk service. This policy is part of the Terms of Service. Breaking it is grounds for immediate suspension or termination of your account, with no refund.

TL;DR

Use GoDesk to access devices you own or have permission to access. Do not use it to attack, surveil, defraud, or harass anyone. Do not run malware through it. Do not break the law with it.

We reserve the right to ban any account, IP, or peer ID at any time if we reasonably believe this policy has been violated.

01Scope

This Acceptable Use Policy ('AUP') applies to anyone who uses the GoDesk client, the godeskflow.com web app, the relay infrastructure, or any related service operated by upDevTeam LTD.

It is incorporated by reference into the Terms of Service. In case of conflict between the AUP and the Terms, the AUP controls for the matter at issue.

02Prohibited uses

You must not use the Service, or allow anyone using your account to use the Service, to:

  • Access without permission. Connect to a device, network, or account without the clear, informed consent of its owner or rightful operator. 'I had the password' is not consent.
  • Surveillance and stalkerware. Install, configure, or operate the GoDesk client on someone else's device for covert monitoring of that person, including stalkerware, intimate-partner surveillance, or workplace monitoring without the legally required disclosure.
  • Malware and intrusion. Distribute viruses, ransomware, spyware, worms, trojans, rootkits, or any other malicious software; conduct port scans, brute-force attacks, credential stuffing, or any other unauthorised security testing.
  • Spam and abuse. Send unsolicited bulk messages, automated solicitations, or commercial messaging in violation of any anti-spam law (CAN-SPAM, EU ePrivacy, etc.).
  • Illegal content. Transmit, host, or facilitate access to content that is illegal in your jurisdiction or in the Republic of Cyprus, including child sexual abuse material (CSAM), terrorist content, content promoting violence or self-harm, or material distributed in violation of intellectual-property law.
  • Sanctions and export controls. Use the Service in or for the benefit of any country, region, or person subject to comprehensive sanctions imposed by the EU, the United Kingdom, the United Nations Security Council, or the United States, or in violation of any export-control law.
  • Fraud and identity. Impersonate any person, misrepresent your affiliation with any entity, or use the Service to commit, facilitate, or conceal fraud, money-laundering, tax evasion, or any similar offence.
  • Harassment and threats. Use the Service to harass, threaten, intimidate, or defame any person, or to organise or promote violence against any person or group.
  • Critical infrastructure. Use the Service in connection with operation of nuclear facilities, life-support systems, weapons systems, air-traffic control, or any other application where failure could lead to death, personal injury, or environmental damage.
  • Service abuse. Probe, scan, or test the vulnerability of any GoDesk system or network without our prior written authorisation; circumvent any rate limit, quota, or authentication mechanism; or attempt to gain access to any data not intended for you.
  • Resale without agreement. Resell, rebrand, or redistribute the hosted Service or any portion of it without a written commercial agreement with us. The AGPL-3.0 covers source code only.
  • Anti-competitive misuse. Use the Service to scrape, benchmark, or copy proprietary aspects of the Service in order to build a competing product, beyond the rights granted by the AGPL-3.0.

04Infrastructure protection

You must not, directly or through any third party:

  • use the Service in a way that disrupts, degrades, or overloads the relay or the public website;
  • open more concurrent sessions or relay more bandwidth than your plan allows;
  • use automated tools or scripts to interact with the Service except via documented APIs;
  • tunnel any general-purpose VPN, proxy, or anonymisation traffic through the relay infrastructure.

05Enforcement

If we reasonably believe that you have breached this AUP, we may take any of the following actions, in any combination, without prior notice and without refund:

  • Warning. Notify you of the alleged violation and require corrective action within a stated period.
  • Throttling. Reduce your relay bandwidth, concurrent session count, or other quotas while we investigate.
  • Suspension. Disable your account or specific peer IDs, immediately and without prior warning, where the breach is severe or ongoing.
  • Termination. Permanently terminate your account and ban your peer IDs and IPs from the Service.

We may also report violations to law-enforcement authorities, hosting providers, or other third parties as required by law or as we consider appropriate to protect the Service, our users, or the public.

06Reporting abuse

If you believe a GoDesk user is breaking this AUP, write to info@godeskflow.com with as much detail as possible: peer IDs, timestamps (with timezone), screenshots, and the conduct you observed.

Reports concerning child safety should be sent to info@godeskflow.com with the subject line 'CSAM REPORT'. Reports about active cyberattacks should be sent to info@godeskflow.com.

07Intellectual-property complaints

If you are a rights-holder and you believe content transmitted through the Service infringes your intellectual-property rights, send a notice to info@godeskflow.com containing:

  • your name, organisation, and contact details (postal address, email, telephone);
  • identification of the work allegedly infringed;
  • identification of the alleged infringing material (peer ID, URL, or other locator) sufficient to allow us to find it;
  • a statement that you have a good-faith belief that the use is not authorised by the rights-holder, its agent, or the law;
  • a statement, under penalty of perjury, that the information in the notice is accurate and that you are authorised to act for the rights-holder;
  • your physical or electronic signature.

We will review valid notices and may remove or disable access to the affected material. Repeat infringers will have their accounts terminated.

If you believe content was removed in error, you may submit a counter-notice to info@godeskflow.com following an equivalent format. False notices submitted in bad faith may give rise to liability for damages.

08Appeals

If your account is suspended or terminated under this AUP and you believe the action was a mistake, write to info@godeskflow.com within 30 days of the action with a clear explanation. We will review and respond within 14 days.

We are not obliged to reinstate any account, and our decision on appeal is final, except for any rights you may have under mandatory law.

09Changes to this policy

We may update this AUP from time to time to reflect emerging abuse patterns, regulatory change, or product change. Material changes are announced on godeskflow.com at least 30 days before they take effect, except where the change is required by law to take effect sooner.

This AUP is enforced at our discretion. We will not enumerate every possible misuse here; the absence of a specific prohibition does not mean the conduct is permitted.
